At SABLE & DUSK, privacy is an essential part of the collector experience. This policy explains how we collect, use, store and protect personal information when you visit our website, create a collector account, acquire digital artwork or communicate with our gallery.

SABLE & DUSK is a trading name of APEX CREATIVE LTD, registered in England and Wales under company number 15284942. APEX CREATIVE LTD is the data controller responsible for the personal information described in this policy.

02. Information We Collect

Depending on your interaction with our gallery, we may collect your name, email address, collector account details, authentication records, correspondence and information you provide through enquiries.

When you acquire artwork, we record relevant purchase information, including the artwork, transaction reference, purchase date, amount paid, edition number and order status.

Our website and service providers may also process technical information such as IP addresses, browser details, device information and security logs. Card payment details are processed by Stripe rather than stored directly in our gallery database.

03. How We Use Your Information

We use personal information to create and manage collector accounts, process artwork acquisitions, maintain order and edition records, provide access to purchased digital artwork and certificates of authenticity, and send essential service communications.

We also use relevant information to respond to enquiries, support collectors, maintain website security, prevent fraud, resolve technical issues and meet applicable legal obligations.

04. Legal Bases for Processing

Under the UK GDPR, we process personal information where necessary to perform a contract with you, comply with legal obligations, or pursue legitimate interests such as website security, fraud prevention and responding to enquiries, subject to your rights and freedoms.

Where processing requires consent, such as certain optional marketing communications or non-essential tracking technologies, we will request that consent before proceeding.

05. Payments and Transactions

Payments are processed through Stripe, an independent payment services provider. Stripe may process payment details, billing information and fraud-prevention information in accordance with its own privacy practices.

SABLE & DUSK receives the transaction information required to confirm purchases, maintain records and fulfil artwork acquisitions.

06. Collector Accounts and Digital Delivery

We use Supabase services for collector authentication, database functionality and digital storage. Account and purchase records help us authenticate collectors, provide access to acquired artwork and administer limited-edition ownership documentation.

We use reasonable technical and organisational measures to protect collector information and access to digital assets.

07. Service Providers and Data Sharing

Our service providers include Supabase for authentication and storage, Stripe for payments, Vercel for website hosting and Zoho Mail for gallery correspondence.

We share information with service providers where necessary to operate the gallery, and may disclose information to professional advisers or authorities where legally required. We do not sell collector personal information.

08. International Data Transfers

Some service providers may process or access information outside the United Kingdom. Where international transfers occur, we use applicable lawful transfer mechanisms and safeguards required under UK data protection law.

09. Cookies and Similar Technologies

Our website may use essential technologies to support authentication, security, shopping basket functionality and user sessions.

We do not currently use Google Analytics or Meta Pixel. If we introduce non-essential analytics, advertising or tracking technologies, we will update our disclosures and obtain consent where required.

10. Marketing Communications

SABLE & DUSK does not currently send marketing newsletters or promotional collection announcements. We may contact collectors about their accounts, purchases, artwork delivery or essential service matters.

If we introduce optional marketing communications, we will provide appropriate subscription choices and comply with applicable UK electronic marketing requirements.

11. Data Retention

We retain personal information only for as long as necessary for the purposes for which it was collected, including contractual administration, collector entitlements, security and legal obligations.

Purchase and accounting records may be retained for legally required periods. Collector account details, artwork edition records, correspondence and technical logs are retained according to their respective operational and legal purposes. We review information and delete or anonymise it when no longer required, subject to applicable obligations.

12. Your Privacy Rights

Depending on the circumstances, you may have rights to access, correct or erase personal information, restrict processing, object to certain processing, request data portability and withdraw consent where consent is the lawful basis.

SABLE & DUSK is intended for adult collectors. Our services are not specifically directed towards children, and we do not knowingly seek to collect personal information from children.
