SABLE & DUSK / LEGAL

Terms & Conditions

The principles governing artwork acquisition, ownership documentation and the collector experience.

Last updated — 25 October 2026

01. About SABLE & DUSK

These Terms & Conditions govern the use of www.sabledusk.com and purchases made through SABLE & DUSK, a trading name of APEX CREATIVE LTD, registered in England and Wales under company number 15284942.

Our registered office is 91 Hazelwood Avenue, Morden, Surrey, SM4 5RS, United Kingdom. For enquiries, contact concierge@sabledusk.com.

Nothing in these Terms limits or excludes rights that cannot lawfully be excluded under applicable consumer protection legislation.

02. Artwork and Limited Editions

SABLE & DUSK offers curated digital fine artworks, including limited editions identified by edition numbers and associated certificates of authenticity.

Artwork descriptions, edition quantities, prices and included deliverables are specified on the relevant artwork page at the time of purchase.

An edition number identifies the collector's licensed edition. It does not transfer copyright or other intellectual property rights in the underlying artwork.

We aim to maintain accurate edition records and not knowingly issue more numbered editions than the stated edition limit. Edition terms, including any artist proofs or other exceptions, should be disclosed before purchase.

03. Orders and Payment

By placing an order, you offer to purchase the selected artwork under these Terms. An order is accepted when we confirm the purchase following successful payment, subject to availability and verification.

Prices are displayed in the currency shown at checkout. Any applicable taxes or additional charges will be disclosed before payment.

Payments are processed securely through Stripe. We may decline or cancel an order where reasonably necessary because of payment failure, suspected fraud, incorrect pricing or an unavailable edition. Where payment has been taken for an order we cannot fulfil, we will provide an appropriate refund.

04. Digital Artwork Delivery

Digital artworks are normally made available through the collector portal promptly after successful payment and order confirmation.

You are responsible for maintaining access to your account and using compatible software and equipment to access the supplied files. Any material technical requirements or compatibility limitations should be identified before purchase.

If you experience difficulty accessing your purchase, contact concierge@sabledusk.com so that we can investigate and provide appropriate assistance.

05. Personal Display Licence

Subject to these Terms and any artwork-specific conditions disclosed before purchase, the collector receives a personal, non-exclusive licence to access and privately display the purchased digital artwork.

The licence does not permit commercial exploitation, public distribution, sublicensing, unauthorised sharing, modification for commercial purposes or the creation of physical reproductions without prior written authorisation from SABLE & DUSK or the relevant rights holder.

You may retain copies reasonably necessary for your authorised personal display and secure backup, provided they are not distributed or otherwise exploited contrary to these Terms.

The licence is transferable only in accordance with the approved transfer procedure described below, subject to applicable law.

06. Copyright and Intellectual Property

Copyright and other intellectual property rights remain with the relevant artist or rights holder. Purchasing an artwork edition does not transfer those rights to the collector.

SABLE & DUSK grants or arranges only the rights expressly stated in the applicable licence and purchase documentation.

No right to manufacture, print, paint, reproduce, commercially display, sell merchandise featuring, or otherwise exploit the artwork is granted unless separately authorised in writing.

These restrictions do not prevent activities expressly permitted by applicable law.

07. Certificates of Authenticity

Where included with an artwork, a certificate of authenticity identifies the artwork, edition number and relevant acquisition details.

Certificates and edition records are intended to support provenance and identification. They do not themselves transfer copyright or guarantee future market value, investment performance or resale opportunities.

Collectors should keep their account credentials and ownership documentation secure.

08. Edition Transfers and Resale

Collectors wishing to transfer a digital edition should contact SABLE & DUSK before the proposed transfer. We operate a controlled transfer process intended to protect edition integrity and maintain accurate collector records.

Subject to applicable law, a contractual transfer of the personal-display licence requires our prior written approval, verification of the edition and confirmation that the recipient accepts the applicable licence terms.

Following an approved transfer, we may update the collector registry and arrange access for the recipient. The transferring collector must cease using the edition and delete retained copies except where retention is legally permitted or otherwise authorised.

Approval of a transfer does not constitute a guarantee of authenticity beyond our verified records, a promise to facilitate resale, or any assurance of future value.

Nothing in this section restricts statutory rights or lawful dealings that cannot be prohibited by contract.

09. Consumer Cancellation Rights

Consumers purchasing at a distance may ordinarily have a statutory 14-day cancellation right, subject to applicable exceptions and conditions.

For digital content not supplied on a tangible medium, the statutory cancellation right may be lost once supply begins, but only where the legal requirements are met, including the consumer's prior express consent to supply during the cancellation period, acknowledgement of the resulting loss of cancellation rights, and the required contract confirmation.

Where those requirements have not been met, or where another statutory right applies, we will honour the consumer's rights under applicable law.

Any consent and acknowledgement requested at checkout will be separate from general acceptance of these Terms where required.

10. Faulty Digital Content and Refunds

Digital content must meet applicable legal standards, including requirements concerning description, satisfactory quality and fitness for purpose.

If purchased digital content is faulty, misdescribed or otherwise does not conform to the contract, you may be entitled to repair, replacement, a price reduction or another statutory remedy, depending on the circumstances.

A loss of the change-of-mind cancellation right following lawful immediate digital delivery does not remove statutory remedies for faulty digital content.

For assistance or a refund request, contact concierge@sabledusk.com with your order details.

11. Bespoke Physical Artwork Services

SABLE & DUSK may introduce optional services for professionally producing digital artworks as physical pieces, including canvas, specialist printing, hand-painted interpretations, framing or other commissioned formats.

These services are not included in a standard digital artwork purchase unless expressly stated in the relevant offer or order confirmation.

If offered, physical commissions will be subject to a separate written quotation or service agreement covering the agreed dimensions, materials, finish, production method, pricing, delivery arrangements and anticipated timescales.

Applicable consumer cancellation rights and exceptions, including those relating to genuinely personalised or made-to-specification goods, will be explained before the relevant contract is concluded.

12. Delivery and Professional Installation

SABLE & DUSK may also introduce optional delivery, positioning, mounting and installation services performed by suitably appointed professionals.

Where available, the scope of installation, site requirements, access arrangements, charges, scheduling and responsibilities will be agreed separately before work begins.

Installation services are not included in current digital-only acquisitions unless explicitly agreed. Any future service terms will preserve applicable consumer rights concerning reasonable care and skill.

13. Collector Accounts

You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials and notifying us promptly of suspected unauthorised access.

We may take proportionate steps to protect the security of collector accounts and prevent fraud or misuse.

Where account access is restricted or suspended, we will take account of existing purchase entitlements and applicable legal obligations.

14. Website Use

You agree not to misuse the website, interfere with its operation, attempt unauthorised access, distribute malicious software or infringe the intellectual property rights of SABLE & DUSK, its artists or other parties.

Website content, branding, images and artwork may not be copied or exploited beyond permissions expressly granted or permitted by law.

15. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability arising from consumer rights that cannot legally be excluded.

Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses arising solely from circumstances outside our reasonable control.

Any additional liability provisions for future physical production or installation services will be stated in the relevant service agreement.

16. Privacy

Personal information is handled in accordance with our Privacy Policy, available at www.sabledusk.com/privacy.

We use relevant service providers to operate collector accounts, process payments and deliver digital artworks.

17. Changes to These Terms

We may update these Terms to reflect changes in our services, legal requirements or business operations.

The version applicable to an accepted purchase will generally be the version presented when that contract was concluded, unless a lawful variation is agreed or required.

18. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, without depriving consumers resident elsewhere of mandatory protections that apply to them.

Consumers may have rights to bring proceedings in the courts of their place of residence where applicable law permits. Nothing in these Terms removes those rights.

If a dispute arises, please contact concierge@sabledusk.com first so that we can attempt to resolve it.
